1. Acceptance of Terms

By creating an account, using, or accessing Phynd.io, you confirm that you understand and agree to comply with these Terms. Phynd.io reserves the right to deny or revoke access to anyone found in violation of these Terms or applicable laws.

2. Authorization of Domain Scanning

You must have the explicit right to scan any domain you submit to Phynd.io, whether by ownership, control, or lawful permission from the domain's owner. By submitting a domain for scanning, you certify and warrant that you have full authorization to do so.

Unauthorized scanning of domains is strictly prohibited and may result in termination of your account, legal action, and potential civil and criminal liability.

Phynd LLC reserves the right to verify domain authorization and may request supporting documentation. Failure to provide evidence of authorization upon request may lead to account suspension or termination.

3. License Grant

Phynd.io grants you a limited, non-exclusive, non-transferable, revocable license to access and use the vulnerability scanning services in compliance with these Terms. Any rights not expressly granted herein are reserved by Phynd LLC.

4. Permitted and Prohibited Uses

You agree not to:

• Use Phynd.io to scan any domain, network, or system you do not own or lack permission to scan.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Phynd.io.
• Reproduce, modify, distribute, or create derivative works based on any part of Phynd.io, except as authorized in writing.
• Interfere with, disrupt, or attempt unauthorized access to Phynd.io, its servers, or any connected networks.

5. User Responsibilities

You are solely responsible for:

• Ensuring that each domain you submit for scanning is under your control or that you have explicit authorization to scan.
• Any unauthorized or illegal activity conducted through your Phynd.io account.
• Protecting your login credentials and restricting access to your account.

Phynd.io may, at its discretion, suspend or terminate your account if you are found in violation of these responsibilities or if unauthorized scanning is detected. Phynd LLC will cooperate fully with law enforcement and may provide information on suspected misuse as required.

6. Data Collection and Use

By using Google authentication through Auth0, Phynd.io may collect data including your name, email address, and profile information for verification, security, and authentication purposes. Phynd.io may use this data solely to manage your account and improve the service. This data is not shared with any third party, except Auth0, and is retained only as necessary for service provision or compliance purposes.

7. Disclaimer of Warranties

Phynd.io provides its services on an “as-is” and “as-available” basis without warranties of any kind. Phynd LLC makes no guarantees that its services will be uninterrupted, error-free, secure, or meet your requirements.

8. Limitation of Liability

To the maximum extent permitted by law, Phynd LLC and its officers, agents, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business, arising out of or in connection with your use of Phynd.io.

9. Indemnification

You agree to indemnify, defend, and hold harmless Phynd LLC, its officers, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including legal fees) arising out of or related to:

• Your unauthorized or unlawful use of Phynd.io.
• Any violation of these Terms.
• Claims by third parties related to your submission of unauthorized domains for scanning.

10. Modifications to Terms

Phynd.io reserves the right to modify these Terms at any time. Any updates will be communicated through notices on the website or via email. Continued use of Phynd.io after such changes constitutes your acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Delaware, without regard to conflict of law principles. Any disputes arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to such jurisdiction or venue.
